Welcome to Junebugg Photography LLC (“Photographer,” “we,” “our,” or “us”). By accessing or using our website (the “Site”) hosted on Webflow, or by submitting an inquiry, booking, or payment through HoneyBook, you agree to comply with and be bound by these Terms & Conditions (“Terms”). Please read them carefully before using our services.
1. General Use of Website
1.1 Eligibility. By using this Site, you represent that you are at least 18 years old or have parental/guardian consent.
1.2 Purpose. The Site is provided for the purpose of viewing our portfolio, learning about our services, and submitting inquiries or booking sessions.
1.3 Accuracy. While we strive to keep information current, we cannot guarantee the accuracy, completeness, or availability of any content or services described.
2. Inquiries and Bookings
2.1 HoneyBook CRM. All official inquiries, bookings, contracts, and payments are processed through HoneyBook. Completing a form on our Site does not confirm a booking until a signed agreement and retainer payment are received through HoneyBook.
2.2 Contracts. Photography sessions are governed by a signed Photo Session Services Agreement, which supersedes and controls over any conflicting website content.
2.3 Deposits. A non-refundable retainer is required to secure your session. Pricing and package details will be outlined in your HoneyBook proposal/contract.
3. Services & Deliverables
3.1 Scope. Services include, but are not limited to, lifestyle sessions, equine portraits, ranch/branding day coverage, and branding photography as described in our Services page.
3.2 Delivery. Online galleries are typically delivered within 2–3 weeks unless otherwise agreed. Final edited images are provided digitally via a password-protected gallery. RAW files are not delivered.
3.3 Archiving. Digital galleries remain active for 1 year. After that time, Junebugg Photography may purge files from its archives. Clients are responsible for downloading and storing their images.
4. Intellectual Property & Usage
4.1 Copyright. All images remain the sole property of Junebugg Photography LLC and are protected by U.S. copyright laws.
4.2 License to Client. Clients receive a limited license for personal or agreed-upon commercial use as outlined in their contract.
4.3 Restrictions. Images may not be altered (filters, AI edits, face-tune, cropping out watermarks), resold, or submitted to contests without prior written consent.
4.4 Credit. When posting online, Clients must credit Junebugg Photography.
5. Payments & Fees
5.1 Payment Platform. All payments are processed securely via HoneyBook, Zelle, or cash as outlined in your agreement.
5.2 Finality. Due to the custom nature of photography, all sales are final.
5.3 Travel Fees. Sessions outside our service area may incur travel or lodging expenses, agreed upon in advance.
6. Liability & Assumption of Risk
6.1 Limitation. Junebugg Photography’s liability is limited to the total amount paid under your contract.
6.2 Equine/Outdoor Sessions. Clients acknowledge the inherent risks of equine and outdoor sessions. Photographer is not liable for injury to persons, animals, or property.
6.3 Equipment/Acts of God. We are not liable for loss of images due to equipment malfunction, lab errors, or force majeure events (weather, natural disasters, illness, etc.).
7. Rescheduling, Cancellations & No-Shows
7.1 Rescheduling. Clients may reschedule within 6 months if at least 30 days’ notice is given.
7.2 Cancellations. Retainers are non-refundable. Cancellations within 30 days may require payment of the full session fee.
7.3 Photographer Cancellation. If Photographer must cancel due to illness or emergency, either a replacement Photographer will be arranged, or all payments will be refunded.
7.4 Late Policy. Clients arriving more than 10 minutes late will have session time reduced. No-shows result in forfeiture of fees.
8. Privacy & Data Security
8.1 Personal Information. We collect basic information (name, email, phone, event details) through inquiry forms and HoneyBook.
8.2 Data Handling. Information is used solely for communication, proposals, contracts, and delivering services.
8.3 Third Parties. We do not sell personal data. HoneyBook’s platform has its own privacy and data-security measures, which apply to all transactions.
9. Model Release & Portfolio Use
9.1 Unless otherwise restricted in writing, Clients grant Junebugg Photography the right to use session images for portfolio, marketing, advertising, and promotional purposes (website, social media, print).
9.2 Restrictions may be requested before the session and must be agreed upon in writing.
10. Governing Law & Dispute Resolution
10.1 These Terms are governed by the laws of the State of Arizona, with venue in Clients Preferred Location.
10.2 Any disputes shall first be attempted to be resolved through mediation or arbitration before litigation.
11. Amendments & Severability
11.1 We may update these Terms at any time. The updated date will be posted at the top of this page.
11.2 If any provision is found unenforceable, the remainder shall still apply.
